These Terms of Service (“Terms”) govern your access to and use of Camplist.Guide (the “Service”) operated by CampList LLC (“Company,” “we,” “our,” or “us”). By clicking “I Agree,” checking a box, or otherwise using the Service, you agree to be bound by these Terms. If you do not accept them, do not use the Service.

You retain ownership of content you submit (e.g., custom checklist items, photos). By posting, you grant us a non-exclusive, worldwide, royalty-free license to host, display, and reproduce that content solely to operate and improve the Service. You warrant that you own or have rights to post the content and that it does not infringe any third-party rights.

The Service and its original content, features, and functionality (excluding UGC) are and will remain the exclusive property of the Company and its licensors. All trademarks, logos, and trade names are our intellectual property and may not be used without prior written consent.

5. DMCA Notice & Takedown

If you believe content on the Service infringes your copyright, send a notice to our designated agent at dmca@camplist.guide that satisfies 17 U.S.C. § 512(c)(3). We will respond per the Digital Millennium Copyright Act and may remove or disable access to the material.

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and share information.

The Service may contain links to third-party sites or services we do not control. We are not responsible for their content or practices. Access them at your own risk.

8. Disclaimer of Warranties

The Service is provided “AS IS” and “AS AVAILABLE,” without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, secure, or error-free.

To the fullest extent permitted by law, the Company and its suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use of or inability to use the Service; (b) any conduct or content of any third party; (c) unauthorized access, use, or alteration of your transmissions or content. Our aggregate liability shall not exceed USD 100.

You agree to defend, indemnify, and hold harmless the Company, its affiliates, and their respective directors, officers, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of the Service or breach of these Terms.

12. Governing Law & Venue

These Terms are governed by the laws of the Commonwealth of Pennsylvania, U.S.A., without regard to conflict-of-law principles. Any dispute that is not subject to arbitration will be resolved exclusively in the state or federal courts located in Allegheny County, Pennsylvania, and you consent to personal jurisdiction there.

13. Dispute Resolution & Arbitration

Mandatory arbitration. Any dispute arising out of or relating to these Terms or the Service will be resolved through binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration will take place in Pittsburgh, Pennsylvania, unless mutually agreed otherwise. You and the Company waive the right to a jury trial and to participate in class actions.

14. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is otherwise harmful to other users, us, or third parties.

15. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by updating the “Last updated” date and, where appropriate, sending an email or displaying a prominent notice. Your continued use after changes become effective constitutes acceptance.
